By accessing or using Aiqarus ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Aiqarus provides an enterprise platform for creating, deploying, and orchestrating autonomous AI agents with audit trails, safety controls, and enterprise security features.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account.

4. Acceptable Use

You agree not to:

• Use the Service for illegal purposes
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use the Service to harm others
• Violate any applicable laws or regulations

5. Fair Usage Policy

To ensure reliable service for all customers, the following fair usage guidelines apply:

5.1 Resource Limits

• API requests are subject to rate limits based on your subscription tier
• Agent execution time and concurrent agent runs are limited per plan
• Storage for documents, memory, and audit logs is allocated per subscription
• Specific limits for your plan are detailed in your subscription agreement

5.2 Prohibited Activities

• Automated bulk operations designed to circumvent rate limits
• Using the Service to train competing AI models
• Reselling or redistributing Service access without authorization
• Creating agents that generate spam, fraudulent content, or misinformation
• Cryptocurrency mining or other resource-intensive non-authorized uses

5.3 Overage and Enforcement

If your usage exceeds your plan limits, we may: (a) notify you and offer an upgrade path, (b) temporarily throttle your access, or (c) charge overage fees as specified in your agreement. Persistent or egregious violations may result in account suspension.

5.4 Enterprise Customers

Enterprise agreements may include custom usage limits, dedicated resources, and tailored fair usage terms. Contact your account representative for details.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Aiqarus and are protected by international copyright, trademark, and other intellectual property laws.

7. Your Content

You retain ownership of content you create using the Service. By using the Service, you grant us a license to process your content as necessary to provide the Service.

8. Payment Terms

Paid plans are billed in advance on a monthly or annual basis. Fees are non-refundable except as required by law. We may change pricing with 30 days notice.

9. Service Level Agreement

Enterprise customers may be subject to a separate Service Level Agreement with specific uptime commitments and remedies.

10. Limitation of Liability

To the maximum extent permitted by law, Aiqarus shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

11. Termination

We may terminate or suspend your account at any time for violations of these Terms. Upon termination, your right to use the Service will cease immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service.
